A law on criminal liability for non-payment of anti-dumping duties is adopted

The State Duma has adopted in its final reading a bill which makes it a criminal offence to evade payment of anti-dumping and countervailing duties. This would be punishable by imprisonment.

Thus, in case of evasion of such dues payment fines are to be paid - for a large amount of the crime will be from 100 thousand to 500 thousand rubles, also there will be forced labor or imprisonment for up to two years.

In case of especially large size the fine will make from 300 thousand to 500 thousand rubles, and imprisonment up to five years. Duty evasion by an organized group will entail imprisonment for seven to 12 years with a fine of up to 1 million rubles.

Duty evasion shall be deemed committed on a large scale if the total amount exceeds two million roubles, on a particularly large scale if it exceeds six million roubles.

This law, according to the explanatory note, is aimed at implementation of the agreement on the Eurasian Economic Union, under which special, anti-dumping and countervailing duties may be introduced for products imported into the common customs territory of the union.

It is noted that "non-payment of duties results not only in reduced revenues of the federal budget but also in reduced production of similar domestic products both directly in the affected industry and in related industries.

At the same time, according to the authors of the law, now there is an increase in the number of cases when dues are unpaid, but the law does not provide for responsibility for such a violation.
